He avoided it because he's an ex cop, imo. The substance of the proffered explanation for his avoiding a murder charge is preposterous - such defenses have been unwelcome in courtrooms for years, if not for decades.

Why wasn't he acquitted of all charges? This is an obvious case of justifiable self defense?

He did tell the victim that he wasn't gay. The victim should have listened. It is completely absurd for a gay man to try to kiss a straight man after being warned. He won't do that again.
